VTA COOPERATES WITH INDONESIA DISPUTE BOARD (IDB)

The cooperation between VTA and IDB aims to jointly explore, promote, and leverage the opportunities and capacities of both parties to advance dispute resolution in business through arbitration and other alternative dispute resolution (ADR) methods in Vietnam, Indonesia, and other countries in the Asia region

On the morning of October 9, 2024, in Ho Chi Minh City, a Cooperation Agreement signing ceremony took place between the Vietnam Traders Arbitration Centre (VTA) and the Indonesian Dispute Board (IDB).

IDB, also known as Dewan Sengketa Indonesia, is an independent institution based in Indonesia. It provides services related to dispute resolution, including arbitration, mediation, and dispute board services, to ensure effective, efficient, and impartial resolutions for various types of disputes.

Attendees of the event included Mr. Sabela Gayo, President of IDB, along with six members who are arbitrators and experts of IDB. Representing VTA were Mr. Pham Xuan Sang, President of VTA, members of the Executive Board, VTA Arbitrators, and the Secretariat.

The objective of this collaboration between VTA and IDB is to jointly seek and promote opportunities and capabilities for advancing business dispute resolution through arbitration and other ADR methods in Vietnam, Indonesia, and throughout Asia.

VTA and IDB have agreed to coordinate and implement cooperation programs:

  • Propose and recommend arbitrators from each organization to be included in the other organization’s arbitrator list.
  • Co-host and organize conferences, workshops, training sessions, or other events related to international arbitration and/or other forms of dispute resolution.
  • Jointly research various topics for publication and/or prepare other materials related to international arbitration and/or other dispute resolution methods.
  • Provide and facilitate the use of VTA’s hearing facilities with preferential support for IDB arbitrations held in Ho Chi Minh City. IDB will provide best efforts to arrange venues for VTA arbitrations held in Indonesia.
  • Both parties agree to share plans and schedules for conferences and/or events to attract the interest of the other party, and consult with each other when finalizing plans to hold major events or conferences in the other party's territory.

Additionally, both parties have agreed to cooperate in the following areas: (i) Promoting training activities and information exchange; (ii) Sharing knowledge on best practices in relevant matters; (iii) Displaying publications received from the other party in their libraries/public spaces; (iv) Disseminating information about each other's activities; (v) Providing recommendations for arbitrator appointments upon the other party’s request; (vi) Establishing international arbitration panels or in other specific areas as requested by the other party.

VTA’s Model Arbitration Clause: “Mọi tranh chấp phát sinh từ hoặc liên quan đến hợp đồng này sẽ được giải quyết bằng trọng tài tại Trung tâm Trọng tài Thương nhân Việt Nam (VTA) theo Quy tắc tố tụng trọng tài của Trung tâm này”. “Any dispute arising out of or in relation with this contract shall be resolved by arbitration at the Vietnam Traders Arbitration Centre (VTA) in accordance with its Rules of Arbitration”.

The Vietnam Trade Arbitration Center (VTA) is responsible for organizing and coordinating the resolution of business disputes through institutional arbitration, with jurisdiction over disputes including: (i) disputes arising from commercial activities between parties; (ii) disputes involving at least one party engaged in commercial activities; and (iii) disputes as prescribed by law to be resolved by arbitration.
